Strong backing for the Code of Practice on Transparency of AI-generated Content

The Code of Practice on Transparency of AI-generated Content details a set of measures to help providers and deployers of generative AI systems comply with the legal obligations to mark and label AI-generated content. The code was drafted by independent experts and has been assessed as adequate both by the Commission and the AI Board. It offers signatories a streamlined, predictable and legally certain pathway to guarantee and demonstrate compliance, regardless of the place where the organisations operate or the competent supervisory authority.

The code covers obligations for both providers and deployers of generative AI systems with 2 sections dedicated to each of them. Stakeholders have been invited to sign the sections of the code that apply to them. Although the legal obligation applies only to providers of AI systems, Section 1 can also be signed by providers of marking and detection solutions and providers of AI models that could help providers of generative AI systems implement the mandatory measures in the code.

By the end of July 2026, about 190 organisations across various sectors - including IT, telecom, education, and retail - have signed the code. This preceded the entry into force of the AI Act’s marking obligations on August 2, 2026. About half of the signatories are small and recent companies, highlighting the fast-paced and dynamic nature of the AI ecosystem. This also showcases the added value of the code to facilitate compliance for companies from all sizes with a particular consideration also for the needs of small and medium sized enterprises.

Several well-established and prominent AI companies have committed to adhering to the code. Examples for Section 1 include: Aleph Alpha, Anthropic, Black Forest Labs, Cohere, Google, Meta, Microsoft, Mistral, Open AI, Synthesia. For Section 2, examples include: Bulgari, Fastweb, Getty Images, Iberdrola, Lenovo, Lufthansa.

The code remains open for signature and the list of signatories below will be updated. The AI Office encourages providers and developers of generative AI systems to sign the code and benefit from legal certainty and reduced administrative burden. By signing the code, providers and deployers of generative AI systems signal their intention to promote public trust in AI and to mitigate deception and misinformation.

Signatories will also be invited to collaborate in the two task forces, to be launched in September 2026. Their objectives include sharing best industry practices, providing feedback on the implementation of transparency measures, and advancing the state of the art and the effective implementation of the code.
